DMCA Copyright Policy

Effective Date: October 7, 2025

Bodyandsouldesign by Purifico LLC (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act, 17 U.S.C. §512 (“DMCA”).

This Policy describes the procedures for submitting copyright infringement notices, counter-notices, and our policy regarding repeat infringers.

1. Filing a DMCA Notice of Claimed Infringement

If you believe that content available on this website (the “Site”) infringes your copyright, you may submit a written DMCA notice to our Designated Copyright Agent.

Your notice must include all of the following information pursuant to 17 U.S.C. §512(c)(3):

  1. Identification of the copyrighted work claimed to have been infringed (including registration information, if available).

  2. Identification of the allegedly infringing material and its exact location on the Site (specific URL or direct link).

  3. Your full legal name, mailing address, telephone number, and email address.

  4. A statement that:

    “I have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

  5. A statement, made under penalty of perjury, that:

    “The information in this notice is accurate, and I am the copyright owner or authorized to act on behalf of the copyright owner.”

  6. A physical or electronic signature of the copyright owner or authorized representative.

2. Our Response

Upon receipt of a valid DMCA notice, we will:

  • Review the claim promptly

  • Remove or disable access to the allegedly infringing material where appropriate

  • Notify the user or content provider responsible for the material, when feasible

We aim to review properly formatted notices within 2–3 business days during our operating hours (Daily, 10:00 AM–7:00 PM PT).

Nothing in this Policy requires us to take action beyond what is mandated by applicable law.

3. Counter-Notice Procedure

If material you posted was removed or disabled due to a DMCA notice and you believe it was removed in error or misidentification, you may submit a written counter-notice containing:

  1. Identification of the material removed or disabled and the location where it appeared prior to removal.

  2. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification.

  3. Your full legal name, mailing address, telephone number, and email address.

  4. A statement that you consent to the jurisdiction of the United States District Court for the State of California (or, if outside the United States, that you consent to that court’s jurisdiction), and that you will accept service of process from the party who filed the original DMCA notice.

  5. Your physical or electronic signature.

If we receive a valid counter-notice, we may restore the material within 10–14 business days, unless the original complainant informs us that they have filed a court action seeking to restrain the allegedly infringing activity.

4. Repeat Infringer Policy

In appropriate circumstances and at our sole discretion, we may suspend or terminate access to the Site for users who are determined to be repeat infringers.

For digital products and downloadable content, confirmed copyright violations may result in permanent account termination and revocation of access without refund.

5. Misrepresentation

Under 17 U.S.C. §512(f), any person who knowingly misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

We reserve the right to pursue legal remedies in cases of intentional abuse of the DMCA process.

6. Handling and Retention of Notices

We may forward a copy of a DMCA notice or counter-notice (including contact information) to the relevant party.

We may retain copies of all notices, counter-notices, and related correspondence for legal compliance, dispute resolution, and recordkeeping purposes.

8. Policy Updates

We reserve the right to modify this DMCA Policy at any time. Updates become effective upon posting with a revised Effective Date.
